Customs Clearance
In Turkey, customs is an institution operating under the Ministry of Trade. Customs clearance service is a service aimed at conducting business and transactions with the state while transporting goods or services through customs areas in foreign trade transactions with a foreign state.
The Customs Law No. 4458, which is a set of rules to be followed during foreign trade transactions, is the fundamental source of law in Turkish customs matters. The purpose of this Law is to determine the customs legislation to be applied to goods and vehicles entering the customs territory of the Republic of Turkey. According to Article 5 of the Customs Law No. 4458, everyone may appoint a representative for their work in the customs administrations in order to carry out the transactions foreseen by the customs legislation. Customs representatives are persons residing in Turkey, with the exception of persons making transit or periodic declarations.
Representation can be direct or indirect. In direct representation, the agent acts on behalf of the person he represents, but in indirect representation, the agent acts on his own behalf and at the same time acts on behalf of the person he represents. declare that he acts on behalf of the person represented, indicate that the representation is direct or indirect, and present a power of attorney to the customs authorities.
Professionals who follow and complete all kinds of customs procedures of goods subject to customs through indirect representation and who are permitted by the Undersecretariat of Customs are called customs consultants. In this context, customs consultants act on behalf of the person they represent through indirect representation as well as on their own behalf. Customs consultants are required to declare their activities on behalf of the person represented and submit a power of attorney to the customs administrations.
